بررسی نقش کارشناسان دادگستری امور ورزش در حل اختلافات حقوقی ورزشی

این مقاله به بررسی نقش کارشناسان دادگستری امور ورزش در حل اختلافات حقوقی مرتبط با ورزش می‌پردازد. اختلافات حقوقی در حوزه ورزش یکی از مسائل پیچیده و چالش‌برانگیز است که می‌تواند بر روند حرفه‌ای ورزش، تعاملات میان ورزشکاران، باشگاه‌ها و فدراسیون‌ها تأثیر بگذارد. در این راستا، کارشناسان دادگستری به عنوان افراد متخصص در امور حقوقی می‌توانند نقش کلیدی در پیشگیری و حل این اختلافات ایفا کنند. هدف این تحقیق تحلیل تأثیر حضور این کارشناسان در کاهش منازعات و تسهیل فرآیندهای حقوقی در ورزش است. مقاله با استفاده از روش تحقیق مروری، به بررسی مقالات و منابع علمی موجود از سال 2020 به بعد پرداخته و نتایج آن نشان می‌دهد که کارشناسان دادگستری می‌توانند در حل مسائل مختلفی چون اختلافات قراردادی، حقوق ورزشکاران، تخلفات انضباطی و مسائل مالی نقش مؤثری ایفا کنند. این کارشناسان با تجزیه و تحلیل دقیق مستندات حقوقی و مشاوره به مدیران ورزشی، می‌توانند از بروز مشکلات بزرگ‌تری جلوگیری کرده و به تسریع در فرآیندهای قانونی کمک کنند. بر اساس نتایج، حضور کارشناسان دادگستری نه تنها موجب کاهش پیچیدگی‌های حقوقی می‌شود، بلکه به افزایش شفافیت و رعایت حقوق تمامی طرفین کمک می‌کند. در نهایت، این مقاله تأکید دارد که برای حفظ منافع حقوقی و مالی ورزشکاران، باشگاه‌ها و فدراسیون‌ها، به‌کارگیری مشاوران حقوقی در عرصه ورزش امری ضروری است.

This article examines the role of legal experts in sports in resolving legal disputes related to sports. Legal disputes in the field of sports are a complex and challenging issue that can affect the professional development of sports, interactions between athletes, clubs, and federations. In this regard, legal experts, as specialists in legal matters, can play a key role in preventing and resolving these disputes. The purpose of this research is to analyze the impact of the presence of these experts in reducing conflicts and facilitating legal processes in sports.
Using a review research method, the article examines existing scientific articles and sources from 2020 onwards, and the results show that legal experts can play an effective role in resolving various issues such as contractual disputes, athletes' rights, disciplinary violations, and financial issues. By carefully analyzing legal documents and advising sports managers, these experts can prevent larger problems from occurring and help expedite legal processes.
Based on the results, the presence of legal experts not only reduces legal complexities but also helps to increase transparency and respect the rights of all parties. Finally, this article emphasizes that in order to protect the legal and financial interests of athletes, clubs, and federations, the use of legal counsel in the field of sports is essential.
